Terms and conditions of sale

The deliveries, services and offers of the online store of Vortex Padel SA (CHE-442.005.732 VAT), are carried out exclusively on the basis of these general terms and conditions of sale, even if they have not been expressly agreed again. By ordering the goods, the present conditions are deemed to have been accepted. The application of the customer’s general conditions of purchase is excluded. Any deviations from the general terms and conditions of sale are subject to written confirmation by Vortex Padel SA.

Prices in this catalog are quoted in Swiss francs, net, including VAT and are guaranteed.

The prices indicated in the order confirmation are decisive. They are fixed for goods in stock on the order date. In the event of delivery and supply difficulties, the price in force on the day of the order will apply. Items covered by a warranty are subject to the conditions of the offer valid at the time of purchase. The warranty takes effect on the date of delivery of the item, as evidenced by the accompanying document (invoice), which we ask you to keep in a safe place. Not covered: damage due to improper maintenance, failure to follow operating instructions, or normal wear and tear.

Our delivery commitment is null and void in the event of failure or non-compliance with supply deadlines on the part of our own suppliers, and insofar as this unavailability is not attributable to Vortex Padel SA. If a product is unavailable, we will inform you as soon as possible.

Risk passes to the customer as soon as the shipment has been handed over to the transport company. If shipment is delayed or becomes impossible through no fault of VORTEX PADEL SA, the risk shall pass to the customer upon notification that the goods are ready for shipment. The assumption of transport costs by VORTEX PADEL SA in an individual case has no influence on the transfer of risk.

Unless expressly agreed otherwise in writing, VORTEX PADEL SA, respectively the supplier/manufacturer, guarantees the freedom from defects and the functionality of the ordered product for two years after delivery by VORTEX PADEL SA.

Non-essential deviations from the promised qualities of the goods do not give rise to any warranty claims. No liability is accepted for normal wear and tear or for consumables/attached accessories or attached or integrated batteries.

In the event of a warranty claim, the customer is entitled to repair, replacement or cancellation. VORTEX PADEL SA is free to choose the method of defect correction. If the customer chooses to cancel the contract, an amount will be credited to the current price (maximum the selling price on the order date).

In the event of a warranty case, the warranty period continues to run and is not interrupted. The exchange of parts, components or complete units does not give rise to new warranty periods. Any warranty claims against VORTEX PADEL SA belong solely to the direct customer and are non-transferable.

The legal warranty is totally excluded.

Customers have the right to return goods within 14 days of receipt. The right of return is exercised by returning the goods; however, they must not have been opened or used. The return of the order must be announced on the customer account of the online store; VORTEX PADEL SA will then send a return ticket to the customer by email.

Exercising the right of return transforms the sales contract into a relationship of restitution, whereby the services received under the sales contract must be returned.

Once the goods have been received, the sales price already paid is credited to the customer’s account. However, we reserve the right to withhold the purchase price or to invoice for damage, excessive wear and tear or, if agreed, the cost of shipping the goods. VORTEX PADEL SA may refuse to credit the amount until it has received the returned goods or until the customer has provided proof that he has returned the goods, whichever comes first.

For returns of defective goods, VORTEX PADEL SA requires, in addition to the return or delivery of the defective item for repair, a copy of the invoice that accompanied the item.

In all cases, the customer is responsible for packaging the returned goods so that they are suitable for transport. The customer will be invoiced for any damage/loss of goods caused by improper packaging. If the customer entrusts the goods to a transport company, he assumes the risk of safe transport of the goods. The risk shall only pass to VORTEX PADEL SA upon receipt of the goods at VORTEX PADEL SA.

When sending the item to be repaired or returned, the customer is responsible for ensuring that the data on the item is erased and that no data is lost by making copies, as data may be lost during repair work. Any liability of VORTEX PADEL SA for loss of data, access by third parties or similar events is excluded.

Accepted payment methods are : TWINT, Credit card.

Regardless of the means of payment used, VORTEX PADEL SA will bear the occasional bank charges incurred by the payment, up to the limit of the management fees invoiced by Stripe. All payments are made via Stripe. Any other charges, for whatever reason, will be billed to the Customer.

A payment is considered to have been made only when VORTEX PADEL SA has the amount at its disposal.

If payment is not made within the above-mentioned period, the customer is in default, and VORTEX PADEL SA is entitled to charge interest on arrears of 5% from the relevant date. VORTEX PADEL SA is also entitled at any time to withdraw from the contract, to demand the return of the goods delivered and to claim damages for the cancellation of the contract. All claims become immediately due and payable if the customer is in default, culpably fails to comply with other essential contractual obligations or if VORTEX PADEL SA becomes aware of circumstances that may reduce the customer’s solvency, in particular in the event of suspension of payments or the initiation of composition or conciliation proceedings. In such cases, VORTEX PADEL SA is entitled to withhold deliveries not yet made or to carry them out only against advance payment or provision of securities.

Available items are dispatched by post within approximately 5 to 8 days. Your contribution is required only once per order.

PLEASE NOTE: VORTEX PADEL SA does not deliver to P.O. Boxes and does not deliver to minors or persons under guardianship without the written consent of their parents or guardians.

Items must be returned undamaged and complete in their original packaging (with reference labels), accompanied by the delivery slip, within 7 days of receipt of your package. You are responsible for return postage costs. In the case of an exchange order, the shipping costs for your new order are free.

Check the delivered goods immediately for obvious material and manufacturing defects, as well as transport damage. In accordance with the law, you are obliged to notify us of any defects or anomalies affecting the goods delivered to enable us to remedy them.

All personal data will be treated as confidential. The information required to manage the order will be processed electronically and may be communicated to associated companies for the purpose of managing the order. For further information on customer data management, please refer to our Privacy Statement. It forms an integral part of these general terms and conditions of sale. Consequently, by accepting the general terms and conditions of sale, the customer also accepts the Data Protection.

The applicable law is Swiss law, and any dispute will be handled by the Tribunal d’arrondissement Lausanne.

Vortex Padel SA reserves the right to modify the general sales conditions at any time.

Should any provision of these general terms and conditions of sale be invalid, the validity of the remaining provisions and of the general terms and conditions of sale as a whole shall not be affected. In this case, the relevant legal provisions will apply in place of the invalid provision.
